What happens to your data when you use this website – no tracking and no cookie banner.

Only the German version is legally binding.

As at October 2026

1. Overview

The following notes give an overview of what happens to your personal data when you visit this website. Personal data is any data by which you can be identified personally.

The website operator is responsible for processing the data. Contact details are in the section “Controller”.

We collect data when you provide it (for example in a form) or automatically where it is needed to run the site (technical server logs). We do not use analytics or advertising tools and we do not store tracking cookies.

You have the right at any time to free information, correction or deletion of your stored data, to restriction of processing, to data portability and to lodge a complaint with the supervisory authority. You may withdraw consent at any time with effect for the future.

2. Hosting

Our website runs on servers of Hetzner Online GmbH, Industriestr. 25, 91710 Gunzenhausen, Germany, in data centres within the European Union. When you visit the website, server log files including your IP address are created there (see “Server log files”). The host processes the data on our behalf. Details: hetzner.com/de/legal/privacy-policy.

The legal basis is Art. 6(1)(f) GDPR (legitimate interest in reliable provision of the website).

3. Controller

Herbert + Kohlmeyer Immobilien GmbH
Lychener Straße 2
D-10437 Berlin
Phone: +49 30 780 870 80
Email: office@herbert-kohlmeyer.de

The controller is the natural or legal person who, alone or jointly with others, decides the purposes and means of processing personal data.

4. Retention and legal bases

Unless a more specific retention period is stated in this notice, we keep your data until the purpose for processing ceases. If you ask us to delete it or withdraw consent, we delete the data unless statutory retention duties prevent this.

Depending on the process we rely on your consent (Art. 6(1)(a) GDPR, section 25(1) TDDDG), on pre-contractual steps or performance of a contract (Art. 6(1)(b)), on legal obligations (Art. 6(1)(c)) or on our legitimate interest (Art. 6(1)(f)).

5. Your rights

Within the statutory limits you have the right of access, rectification, erasure, restriction of processing and data portability. You may withdraw consent at any time; processing already carried out remains lawful.

Right to object: if processing is based on Art. 6(1)(e) or (f) GDPR, you may object at any time on grounds relating to your particular situation. If data is processed for direct marketing you may object at any time.

The competent supervisory authority is usually the Berlin Commissioner for Data Protection and Freedom of Information. The right to complain is without prejudice to other remedies.

This site uses SSL/TLS encryption. You can recognise an encrypted connection by the padlock in the address bar and by “https://”.

6. Server log files

The host automatically collects information the browser transmits: browser type and version, operating system, referrer URL, host name of the accessing computer, time of the server request and IP address. This is not combined with other data sources. The legal basis is Art. 6(1)(f) GDPR.

7. Cookies

We do not set tracking cookies or a cookie banner for visitors to this website. Technically necessary cookies arise only if you log in to the WordPress admin area – that does not apply to ordinary site visitors.

Fonts are hosted on our server (no calls to Google Fonts or Adobe Fonts).

8. Forms and enquiries

If you contact us via a form, by email, phone or fax, we store your details including contact data in order to handle the enquiry and any follow-up questions. We do not pass this data to third parties for advertising.

The legal basis is Art. 6(1)(b) GDPR where the enquiry is for entering into or performing a contract, otherwise Art. 6(1)(f) GDPR or your consent (Art. 6(1)(a)), which you may withdraw at any time.

We also store enquiries in an internal archive on this website (visible only to our office) and delete them automatically after 90 days unless statutory retention duties prevent this. In parallel they go as email to our office and – for day-to-day agency work – to our CRM Propstack (Propstack GmbH, Germany). Propstack processes the data on our behalf.

9. Property valuation

For the first price range we only need details of the property (type, address, floor area, rooms, year built, condition). These are used for the calculation and not stored as a personal profile. Limited, short-term logging of the IP address is solely to protect against abuse (Art. 6(1)(f) GDPR).

The price range is calculated by Sprengnetter GmbH, Bundeskanzlerplatz 2D, 53113 Bonn, Germany, using an automated valuation model. For this our server transmits only the property details – never your name, your contact details or your IP address. We cache the result for up to 31 days so that identical details are not transmitted again. Sprengnetter processes the details on our behalf. The legal basis is Art. 6(1)(f) GDPR (legitimate interest in showing you the estimate you asked for straight away). Details: sprengnetter.de/datenschutz.

Only when you request a detailed valuation do we collect name, email and optionally phone, reason and timeframe. We process this data as described under “Forms and enquiries”, together with the range shown.

The instant range is an indication based on market data, not a formal valuation and not a binding offer.

10. Google Maps

On the contact page and in property details you can load an interactive map. The map preview is hosted on our server; a connection to Google is made only when you click “Activate map”. Data (in particular your IP address) is then transferred to Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. A transfer to the USA is possible.

The legal basis is your consent under Art. 6(1)(a) GDPR and section 25(1) TDDDG. You can simply not activate the map. Further information: policies.google.com/privacy.

11. Property photos

Photos of properties for sale come from our agency CRM Propstack, are stored on our server and delivered in sizes suited to the website. Once the images have been imported, the originals are not fetched from third parties.
